Policy Statement
91ÉçÇø is committed to providing timely and accurate information regarding significant threats to the health and safety of the campus community. Consistent with the requirements of the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act), the University utilizes three types of campus safety communications:
- Emergency Notifications – issued for significant emergencies or dangerous situations occurring on the campus that involve an immediate threat to the health or safety of students or employees.
- Timely Warnings – issued for Clery Act crimes occurring within Clery geography that represent a serious or continuing threat to students or employees.
- Safety Advisories – issued to provide awareness and safety information regarding criminal activity, public safety concerns, or incidents that may be of interest to members of the campus community but do not meet the criteria for an Emergency Notification or Timely Warning and are not governed by the Clery Act.
The University may issue more than one type of notification for a single incident when appropriate.
Purpose
The purpose of this policy is to establish the University's process for communicating information about emergencies, criminal incidents, and public safety concerns in order to enhance community awareness, support informed decision-making, and promote personal safety.
Policy
1. Emergency Notifications
In accordance with the Clery Act, 91ÉçÇø will issue an Emergency Notification upon confirmation of a significant emergency or dangerous situation occurring on the campus involving an immediate threat to the health or safety of students or employees.
Examples may include, but are not limited to:
- Active violence or active threat incidents
- Hazardous material releases
- Major fires or explosions
- Severe weather emergencies
- Public health emergencies
- Other situations determined to pose an immediate threat to health or safety of students or employees
Emergency Notifications will be distributed through the University's emergency mass notification system, including B-Alerts, and may be supplemented through additional communication channels as appropriate.
The Chief of Police, Director of Emergency Management, Vice President for Operations, Vice President for Communications & Marketing, or their designees are authorized to initiate Emergency Notifications.
2. Timely Warnings
91ÉçÇø will issue a Timely Warning for Clery Act crimes reported within the University's Clery geography when the University determines that the incident represents a serious or continuing threat to students or employees.
The decision to issue a Timely Warning will be made on a case-by-case basis by the Chief of Police or designee, in consultation with appropriate University officials, in light of all facts surrounding a crime, considering factors such as:
- The nature and severity of the crime;
- Whether there is an ongoing threat to the campus community;
- The likelihood of additional incidents occurring;
- Whether a suspect has been identified or apprehended;
- The possibility of compromising law enforcement efforts; and
- Information known by law enforcement at the time of the assessment.
Crimes that may warrant a Timely Warning include, but are not limited to:
- Murder/non-negligent manslaughter/manslaughter by negligence
- Rape, fondling, incest, statutory rape
- Motor vehicle theft
- Robbery
- Aggravated assault
- Burglary
- Arson
- Stalking
- Domestic violence
- Dating violence
- Hazing
- Weapons possession
- Other Clery-reportable crimes when determined to pose a serious or continuing threat
Cases of aggravated assault, sex offenses, and stalking, dating and domestic violence are considered on a case-by-case basis, depending on the facts of the case and the information known by the University.
Timely Warnings will be issued as soon as pertinent information is available. Timely Warnings will be distributed to students and employees through university email and may be shared through additional communication channels as appropriate.
Timely Warnings will provide information that enables members of the campus community to protect themselves, promotes safety and crime prevention while protecting the confidentiality of victims and preserving law enforcement efforts.
3. Safety Advisories
The University may issue a Safety Advisory to increase awareness of criminal activity, public safety concerns, or other incidents that do not meet the criteria for an Emergency Notification or Timely Warning but may be relevant to members of the campus community. Safety Advisories may also be issued proactively to provide crime prevention information, promote personal safety and security awareness, or address conditions that could present an increased risk to members of the campus community, even when no specific incident has occurred.
Examples may include:
- Criminal activity occurring near campus but outside Clery geography;
- Patterns of minor criminal activity;
- Community safety concerns;
- Fraud or scam warnings;
- Other incidents for which heightened awareness may help community members make informed decisions regarding their safety.
Safety Advisories are not required by the Clery Act and are issued at the discretion of the University.
Safety Advisories will typically be communicated through Dateline, B-Line, and other University communication channels as appropriate.
Authority and Review
The determination to issue an Emergency Notification, Timely Warning, or Safety Advisory is made by the Chief of Police or designee in consultation with appropriate University officials, including the Office of the Vice President for Operations, University Communications and Marketing, and the Clery Compliance Coordinator, as appropriate
